Alec Baldwin I just scored another victory in the ‘Rust’ shooting case… because a judge denied the state’s request to reconsider the dismissal with prejudice.
New Mexico’s First Judicial District Court ruled Thursday, saying many of the arguments prosecutors made had already been raised and did not rise to the level necessary for reconsideration of the decision.
The judge also noted that even though the state filed its paperwork by the August 30 deadline, it filed a motion that went far beyond the allowable page limit without seeking court permission.

The amended motion was filed five days later – outside the appeal deadline… and the judge cited this as another reason to deny the motion.
We have told you everything about the amended motion submitted by Kari T. Morrissey last month… requests the judge to dismiss the case with prejudice, so that they could prosecute Baldwin again.

In the motion, the prosecutor argued that the Baldwin team was aware of the live ammunition on set, and that it was not relevant to his defense anyway.
As you know, it was revealed at trial that the live ammunition evidence had been filed under a different case number – and Baldwin’s lawyers argued that this effectively hid the evidence from his defense team.
