Turner-Smith, 38, alleged in new court documents obtained by We weekly on Monday, December 23, that Jackson, 46, has not paid her child support since news broke in October 2023 that they were splitting up. She requests that he pay her $8,543 per month, retroactive to the date of her initial application. (TMZ was the first to report the news.)
The Bad monkey actress also requested that Jackson pay her $28,641 per month in spousal support while their divorce is still pending. (She initially asked the court to take spousal support off the table, but apparently changed her mind.)
She asks the court to order the case Dawson’s Creek alum to pay her $250,000 to cover her attorney fees and other costs as they continue to work out their legal split.
Turner-Smith claimed that Jackson “promised to always support me” and “assured” her that she “didn’t have to worry about financial security for our daughter if we ever split up because he said he understood how difficult life as a black woman can be. and a single mother.”
She argued in the documents that Jackson made more money than she did during their four-year marriage and accused him of piling up attorneys’ fees by delaying their divorce.
Turner-Smith claimed that the Doctor Odyssey The star “reneges” on his “promise” to financially protect her and their 4-year-old daughter. (The former couple welcomed their child in April 2020.)
Us confirmed in October 2023 that Turner-Smith had filed for divorce from Jackson after four years of marriage. She cited “irreconcilable differences” as the reason for the breakup and listed the date of separation as September 13, 2023.
Turner-Smith, who married the Mighty ducks actor in 2019, noted in initial filings that she was seeking joint custody of their child.
Despite hitting a bump in their legal process, Turner-Smith was positive about her co-parenting experience with Jackson over the past year.

“It’s an adjustment period for everyone when you break up with someone because you’re used to being with your child all the time,” she said. Glamour in an interview published in October. “But no one gives you a manual. Everyone’s trying to figure it out. Every parent has a different life, and especially if the reason you’re splitting up is because you have different lives, it’s only going to be more complicated by how you’re going to co-parent.”
The following month, Turner-Smith related Entertainment tonight that co-parenting comes down to ‘thinking about your children’ at all times. “When you go public with parenting, everything you do is ultimately recorded,” she explained. “You don’t want your kids to read something and think something.”
She added: “It’s about putting the children first and that’s all you can do. No one gets everything right, but if you know you’re focused on the right thing, at least you know you’re going to do your best.”
Jackson – who went out Lupita Nyong’o from fall 2023 to October of this year – has remained quiet about his and Turner-Smith’s ongoing separation. In September, he shared a rare glimpse into his life as a girl dad.
He told it exclusively Us in September that he couldn’t make the most of being a parent. “It’s not a part; it’s the whole thing,” Jackson gushed. “It’s every day. She is a delight.”
Jackson noted that his daughter influences every aspect of his life. “I have a four-year-old. She’s at school. I have to work here and I want to be able to be some kind of father,” he explained. “That’s honestly my main priority.”
Being close to home is what drew the actor to his latest role Doctor Odyssey. “I really wanted to do something where it was lighter, where I didn’t have to go home with a headscarf every night, gloomy and heavy,” he added.
