Robert Vito will not face criminal charges following his arrest last month…although he will speak to the city attorney about alternative conflict resolution in the future.
The Los Angeles District Attorney’s Office tells TMZ … Vito has a hearing soon with the city attorney, where they will talk to him and discuss ways to prevent situations like this from happening in the future.
After that, the case is put on ice… and as long as he doesn’t get into trouble in the next year, he will never be charged for it.
We told the story…RV it was arrested last month for misdemeanor domestic violence charges after police were called to his home over an alleged incident involving his then-girlfriend Lindsey Jennings.
Sources told us that Vito and Lindsey got into an argument that turned physical — with Lindsey claiming that at one point Vito pushed their son and threw him onto the couch.
Officers claim they saw visible injuries on Lindsey’s body and arrested Robert…although a few weeks later the DA’s office announced they have not filed any criminal charges. Now the city attorney won’t even file a misdemeanor charge.
Vito’s lawyer, Bob M. Farahantells TMZ … while they don’t believe Robert should have ever been arrested, they know law enforcement had limited information at the time of his arrest — they only heard Jennings’ side of the story.
Farahan tells us Robert does not condone physical or domestic violence… and he looks forward to moving on from this incident and being an active father to his son.
