The prosecutor is still reviewing Artem Chigvintsev's case ahead of arraignment

The Napa County District Attorney’s Office is investigating the situation Artem Chigvintsev‘s domestic violence case ahead of his Nov. 4 arraignment.

Spokesperson for Napa County DA Carlos Villatoro told TMZ on Wednesday, September 4, that the office is investigating Chigvintsev’s case before charging the professional dancer. According to Villatoro, the prosecutor must review witness statements, footage of the incident and additional evidence from the police investigation.

After a thorough review is completed, the office will publicly announce how it proceeds through the point of sale. Chigvintsev’s arraignment is currently scheduled for November 4.

We weekly confirmed that 42-year-old Chigvintsev was arrested on Thursday, August 29 in Napa County, California for domestic violence. The Dancing with the stars pro was taken into custody and bail was set at $25,000. He was released later that afternoon.

Chigvintsev was arrested under California Penal Code Section 273.5(a), regarding a person causing injury to a spouse, cohabitant or co-parent. If convicted of a crime, Chigvintsev could result in a prison sentence of up to four years and a fine of up to $6,000. If convicted of a felony, Chigvintsev faces a prison sentence of up to one year and a fine of up to $6,000.

According to a 911 call tape obtained by TMZ on Friday, August 30, Chigvintsev called 911 requesting medical attention. During the telephone conversation he accused his wife Nikki Garcia of throwing shoes at him during the alleged altercation.

Minutes after calling, Chigvintsev tried to cancel the 911 call, saying medical attention was not necessary. Police later arrived on scene and found a person with visible injuries. It has not been confirmed whether Garcia, 40, was the injured party. (The couple, who tied the knot in August 2022, share 4-year-old son Matteo.)

Napa Valley Sheriff PIO Henry Wofford told it Us that the victim ‘requested complete confidentiality’. The sheriff added, “We also had the opportunity to speak with the victim and the suspect was arrested without incident.”

Chigvintsev was “not fighting or combative” during the arrest. The sheriff noted the investigation is ongoing.

After news of Chigvintsev’s arrest broke, Garcia broke her silence and asked for privacy.
