As RadarOnline.com previously reported, Martinez already requested that the judge overseeing the case question the actress about her “distorted story” and “false claims.”
His lawyer alleged that Berry “is seeking new, extraordinary and draconian relief, to obtain sole custody of the mental health and educational decisions of the parties’ minor child, including the desire to have only the son of the to give parties psychiatric medication.”
Martinez’s lawyer accused the Cat lady star of “an attempt to muscle his way into an immediate hearing” after a separate motion for emergency orders was denied in July.
The filing continued: “[Berry] makes this sole request for guardianship and refuses to set it at a date sufficiently far in advance [Martinez] to defend it, while I know it very well [Martinez] has asked [Berry] months to pay a contribution to the legal costs, because he does not have sufficient resources to pay his counsel.
‘She rejected this request, despite the fact that [Berry] is currently making several million dollars, and probably even more considering her new movie is about to be released.”
